In July 2008, the Maryland Commission on Capital Punishment was established (Chapters 430 & 431, Acts of 2008). The Commission studied all aspects of capital punishment as currently and historically administered in the State. Commission recommendations address disparities in the administration of capital punishment, including racial, jurisdictional, and socio-economic disparities, as well as the risk of executing innocent people, and the impact of DNA evidence in capital trials. Further, the Commission compared the effects of prolonged court cases involving capital punishment with those involving life imprisonment without possibility of parole. It also considered the costs associated with death sentences as compared with those of life imprisonment without possibility of parole.

The Commission submitted its final report on December 12, 2008. Authorization for the Commission extends through December 31, 2008.
